On 20 March 2020, the four convicts of the gang rape and murder of the Nirbhaya rape case were hanged to death. This execution at the Tihar Jail in Delhi was one of the most recent cases of the death penalty in India.
However, four years later, in 2024, rape is still one of the most common offences committed against women and children.

The infliction of some pain or loss on a wrongdoer for his wrong deeds is known as Punishment. It is a form of social control that regulates the law and order of the society and creates a sense of fear in the mind of the wrongdoer.
Punishment is a legal process that is governed by laws and regulations and must adhere to certain principles and guidelines to ensure fairness and justice. A punishment must be directly proportional to the intensity of the crime.
In the case of Ravji v State of Rajasthan, a division bench held that it is the nature and gravity of the crime and not the criminal that must be considered for appropriate punishment in a criminal trial.
In this report, the authors will talk about capital punishment, also referred to as the death penalty, provide definitions of rape, the changes in Rape Laws through Bhartiya Nyay Sanhita, some cases where the death penalty was awarded as well as the arguments in favour and against the capital punishment.
